2 provisions identified: 1 benefits, 0 costs, 1 mixed.
An excess-proceeds sale ends most state liens and encumbrances on the sold property. Some state assessments and property-tax liens remain. Unpaid state liens against the taxpayer or their other property also remain unless sale proceeds pay them.
A property owner or certificate holder can ask the court to review whether an excess-proceeds sale is reasonable before the judgment takes effect under court rules. The court must review reasonableness when the likely sale price is more than $2,500 above the specified secured amounts. A court-ordered sale must happen within 60 days after judgment, subject to other rules in the law. A party in the case who is entitled to sale proceeds can sue the qualified entity if it fails to distribute them as required.
