Misleading insurance certificates face new penalties

People cannot prepare, issue, request, or require certificates that mislead about coverage, change coverage, or claim a policy meets a contract's insurance or indemnification requirements. A certificate or related document that violates these rules is void. Arizona's insurance director can investigate, order violations to stop, and impose civil penalties up to $1,000 per violation. The director can also adopt rules, and enforcement powers under other laws remain intact. These protections cover Arizona property and casualty risks regardless of where the parties are located, for contracts or addenda entered into on or after the law's effective date.

Insurance certificates cannot add policy rights

An insurance certificate is not a policy and cannot change coverage or add rights beyond the policy. Certificates include documents describing or showing coverage, whatever their title, prepared by insurers, insurance agents, or their representatives. Policies, temporary insurance binders, policy endorsements, and auto insurance identification or information cards are excluded. Someone other than the policyholder gets cancellation, nonrenewal, or major-change notices only when the policy or an endorsement grants that right. These rules cover Arizona property and casualty risks, regardless of where the policyholder, insurer, agent, or requester is located, and apply to contracts or addenda entered into on or after the law's effective date.
