Groundwater users pay per acre-foot fees

The state charges an annual fee for groundwater you withdraw in the Tucson, Phoenix, Pinal, Prescott, and Santa Cruz active management areas. In Prescott and Santa Cruz, the total fee cannot exceed $5.00 per acre-foot used. The administration and enforcement part is $0.50 to $1.00 per acre-foot each year (in Pinal it is not more than $1.00). The augmentation, conservation, and monitoring part is up to $2.00 per acre-foot. In Tucson, Phoenix, or Pinal, the augmentation fee is not charged in an AMA once a permanent AMA water district board has taken office. The director may also charge up to $2.00 per acre-foot to buy and retire grandfathered rights, starting the first year the program is implemented, but not before January 1, 2006. In Santa Cruz, stored water is not charged. The person who withdraws the water, or the owner of the right, must pay.

Water‑banking fee rules and Pinal holiday

In Tucson and Phoenix, you pay $2.50 per acre-foot each year for Arizona water banking. In Pinal, the director may set up to $2.50 per acre-foot for water banking, but no water‑banking fee is charged there during calendar years 2020 through 2030. The law also suspends, for 2020 through 2030, the separate Pinal fee of up to $2.50 per acre-foot for groundwater and irrigation efficiency projects. Result: users in Tucson and Phoenix pay the water‑banking fee, while Pinal users do not pay these two fees during the suspension period.

Fee breaks for small farms and districts

If you are not an irrigation district and you irrigate 10 acres or less under a grandfathered right, you do not pay the listed groundwater withdrawal fees for those withdrawals. This exemption ends if those acres are part of an integrated farming operation. If you are a member of a groundwater replenishment district and you withdraw water in the district for a non‑irrigation use, you do not pay the fee that funds buying and retiring grandfathered rights.
