Beginning July 1, 2027, Colorado state agencies must include a muffler-compliance term in every construction contract. The term requires contractors' and subcontractors' commercial vehicles entering public project sites to follow the state's muffler rules.
Beginning July 1, 2027, Colorado requires mufflers on commercial vehicles with internal combustion engines driven on highways, not just those with engine compression brakes. Farm vehicles are exempt. Mufflers must be placed so officers can visually check that they are present, intact, and working. A hidden muffler requires paperwork kept in the vehicle and available to a peace officer. The paperwork must show installation met federal manufacturing noise standards for the vehicle's model year. It must also list the vehicle identification number, muffler purchase date, make and model, and business that sold and installed it.
For offenses beginning July 1, 2027, commercial vehicle muffler violations are class B traffic infractions with a $1,000 fine, up from $500. Courts must waive the fine when required records prove a muffler was in place before the citation. Courts must cut the fine by 50%, to $500, with proof of proper muffler installation within 30 days after citation. Half of fine revenue goes to the city or town where the violation occurred, or the county for unincorporated areas. The other half goes to the state's Highway Users Tax Fund.
