3 provisions identified: 1 benefits, 0 costs, 2 mixed.
Colorado schools choosing heating, cooling, and ventilation projects paid from the Infrastructure Investment and Jobs Act Cash Fund face new requirements. Qualified personnel must assess filters, airflow, exhaust, controls, and maintenance, with a licensed mechanical engineer reviewing and certifying the assessment report. Providers must complete required fixes and use MERV 13 or better filters where feasible; otherwise, the best the system handles. A certified contractor or qualified personnel must prepare a verification report within 10 business days after work ends. Providers must keep it for at least five years and share it with the public on request. Grant agreements must require compliance, and providers must certify compliance when the grant period ends. The law does not require every school to undertake a project.
For school heating, cooling, and ventilation projects paid from the Infrastructure Investment and Jobs Act Cash Fund, providers must use the state certified-contractor list. Contractors must be certified or pay prevailing wages and use federally or state-registered apprentices. Mechanical, plumbing, and electrical work is exempt under a qualifying project labor agreement that allows competition regardless of collective-bargaining-agreement membership. After reviewing bids, providers can waive these requirements for those portions only with substantial evidence that no responsive, eligible subcontractors are available. Providers must publicly post each waiver and its reasons.
Local education providers now count as local governments for eligible uses of the Infrastructure Investment and Jobs Act Cash Fund. With the governor’s approval, Colorado departments can use the fund for nonfederal matches under that federal law or later infrastructure laws. A new Public-Public Collaboration Unit provides grant-writing, planning, and administrative help, with attention to rural and disproportionately impacted communities. The unit may keep 2.5% of each federal award it helps secure for administrative costs, leaving less for projects. The expanded funding authority sets no dollar amount and guarantees no award.
