Replacement lawyers for low-income death-penalty defendants

Beginning July 1, 2026, Florida provides a replacement-lawyer process for defendants unable to afford counsel when prosecutors formally seek death. The appointed regional counsel office must notify the court if it has a conflict or cannot continue. The court can appoint another region’s office only if it has no conflict and its regional counsel agrees. If no regional office accepts, the judge must appoint private counsel. When another regional office accepts, the Justice Administrative Commission pays case-related costs and services, subject to legislative funding. Counsel must certify that expenses relate to the case and submit expense records.

Lawyer appointment rules for incapacity cases

Beginning July 1, 2026, Florida aligns lawyer appointments for people alleged to be incapacitated with the updated regional counsel rules. Courts must appoint a regional counsel office or a private lawyer through that process. Private lawyers must come from the state’s attorney registry. Courts must rotate private appointments and consider conflicts of interest.
