Florida exempts some drug tests from paraphernalia

Beginning July 1, 2026, Florida excludes certain drug-testing products from its definition of drug paraphernalia. Products must be used only to detect fentanyl, specified dangerous fentanyl or fentanyl-like drugs, or xylazine in controlled substances. Products that can measure a drug’s amount, weight, or strength do not qualify. Qualifying products are no longer treated as drug paraphernalia subject to government seizure.
