Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 2 costs, 1 mixed.

Consumer protections exclude nickel rounding

When the penny is no longer in production, rounding consumer sales to the nearest nickel has a legal exemption. Florida's law against unfair or deceptive practices does not apply to that rounding practice. This exemption does not remove protections for unrelated conduct.

Some seller payments require upward rounding

When the penny is no longer in production, a separate rule applies to cash payments to sellers under section 538.235. These payments must cover the exact amount due or be rounded up to the nearest 5 cents. This rule does not allow rounding down.

Cash shoppers face nickel rounding

The law took effect upon enactment; rounding applies only when the penny is no longer in production. Dealers may round in-person cash totals or change to the nearest 5 cents, using federal law's definition of cash. Final cent digits round as follows: 1–2 down to 0; 3–4 up to 5; 6–7 down to 5; 8–9 up to 10. Amounts ending in 0 or 5 stay unchanged. Noncash payments, including mixed cash-and-noncash payments, are excluded except for cash given to the buyer. Sale prices, taxes, surcharges, assessments, fees, and amounts authorized, cleared, or settled through noncash systems stay unchanged.
