Florida shields records from innocence reviews

Florida keeps certain conviction review records exempt from public disclosure. Conviction integrity units are teams within state attorneys’ offices that review plausible claims of actual innocence. The exemption covers materials from a new investigation after the unit accepts a case in writing. The case must involve a conviction, and the investigation must be active, ongoing, and in good faith. Protection applies for a reasonable period, until the claim cannot be investigated further. It excludes applicant petitions and materials from investigations responding to motions under court rules 3.800, 3.850, or 3.853. Materials from other proceedings challenging a conviction or sentence are also excluded. Earlier criminal investigation records are excluded unless another exemption protects them. The law took effect upon becoming law and removes the scheduled October 2, 2026 repeal, leaving no sunset date.
