Hawaii's transit development council must map each county's transit development areas and plan affordable homes and mixed-use development on state land. Counties designate areas by ordinance, plan, or resolution, generally within one-half mile of transit hubs or stations, with boundary exceptions. The council coordinates funding, lists infrastructure needs, prioritizes projects on state and county lands, and promotes affordable housing partnerships. It also prioritizes state infrastructure financing and reviews state capital project requests in designated areas. Without a county designation, specified reviews and partnerships cover areas within one-half mile of stations; the law took effect upon approval.
The district board must consider transit-supportive building density when choosing infrastructure improvements in county-designated transit areas. Minimum floor-area ratios—total floor space divided by lot size—are generally 4.0, or 6.0 within one-half mile of a qualifying station. Within one-quarter mile, the minimum is the greater of 7.0 or the applicable plan or special-district maximum. The requirements include permit processing using objective standards, without discretionary review, and building rules that allow usable structures at those densities. They also require spending funds collected under the referenced county funding law in the area; no particular project is guaranteed.
Hawaii gives rental funding priority to projects or units serving households earning up to 140% of median family income. Not every unit must meet that limit; projects must show readiness, efficient use of funds, and financial feasibility. A temporary, five-year account also provides loans, investments, and credit support for mixed-income rentals serving legally qualified residents. This account uses a separate application process and favors varied affordability levels, public land or partnerships, efficient spending, and transit-supportive locations. Nonprofit and government projects win ties with for-profit projects, and repayments, fees, interest, and investment returns replenish housing financing. These changes do not guarantee financing or a home.
