Beginning July 1, 2025, state and local agencies must assess how covered projects may affect historic properties, aviation artifacts, or burial sites. The Department of Land and Natural Resources gets a chance to review, but its written agreement is no longer required before a project starts. The Department must respond within 90 days, or within 30 calendar days when no historic properties will be affected. If a complete submittal gets no response by the deadline, the lead agency may assume agreement and move to the next step; the clock pauses while required information or surveys are missing. After written agreement and any needed mitigation, a project generally needs no further review unless its scope or area changes or new protected resources are found; agencies must report certain discoveries within 48 hours, and the Department must respond within five business days.
Beginning July 1, 2025, counties and the Hawaii Community Development Authority must work with the Department to select transit-area parcels and rights-of-way for review. Counties must submit selected sites by January 1, 2026; the Department must rate each site within six months. Qualifying housing projects or supporting infrastructure on parcels rated in the lower two risk levels in every category can avoid further referral when required best practices are followed and substantial construction is reached by June 30, 2036. Highest-risk parcels still require referral. The Department, the submitting county, and the Authority must agree on permitting practices within three months after a parcel is rated, and counties and the Authority must make those practices approval conditions.
