The law removes special water pollution penalties of up to $10,000 per day or instance and up to 30 days in prison. The Hawaii Department of Health continues to handle water pollution enforcement. Other boating violations can still bring a petty misdemeanor penalty of up to $1,000. Parking or traffic violations at boating facilities carry fines of $100 for a first violation, $200 for a second, and $500 for a third or later violation. As a probation condition, an environmental court can bar a defendant from operating a vessel in specified state waters.
