Hawaii’s interim rules for medical cannabis dispensaries stay in place until July 1, 2027. They end sooner if the state adopts replacement rules.
The Hawaii Department of Health can issue fines of up to $5,000 for each medical cannabis law or rule violation. Each day a violation occurs or continues counts separately. The department can also order someone to stop a violation or take corrective action. A person has 20 calendar days after written notice to request a hearing before the penalty or order becomes final, and can appeal a final department order to circuit court.
A registered primary caregiver can serve up to five qualifying patients at a time, up from one. A caregiver can grow an adequate supply for a patient, and each growing location can serve no more than five patients. This caregiver-growing option no longer ends after December 31, 2024.
