The law removes the Department of Health's authority to provide medicine for newborns of indigent or medically indigent mothers who carry hepatitis B. The department may still set rules for prenatal screening, reporting, and follow-up for these newborns.
The law removes a rule denying an implied warranty that blood and related products are free of serum hepatitis virus when no known scientific test can detect it. This applies to products used for injection or transfusion. The law does not say what warranty applies instead.
Beginning July 1, 2025, the Hawaii Department of Health must provide statewide hepatitis education and develop a prevention plan. The plan includes screening and services to help people with hepatitis access care and treatment. The department may work with health providers, insurers, government agencies, and community groups. The law provides $545,000 for each of fiscal years 2025-2026 and 2026-2027, and supports three full-time department positions.
