Signed by Governor
Requires the Department of Labor and Industrial Relations to issue an order of wage payment violation to employers found to be in violation of the State's Wage and Hour Law. Establishes penalties, enforcement, and appeal procedures. Amends the definition of "wage" to clarify that it means compensation for labor or services rendered by an employee, regardless of how it is calculated. (CD1)

3 provisions identified: 1 benefits, 0 costs, 2 mixed.
Hawaii puts collected penalties from several labor laws into a labor law enforcement fund. The fund also receives money lawmakers provide and income earned on the fund. It supports labor-law enforcement, but the law gives no total amount because collections can vary.
Hawaii's wage law counts pay for time, tasks, pieces, commissions, or other work as wages. It also counts the reasonable cost of board, lodging, or other facilities an employer customarily provides. Tips and gratuities are excluded from “wage” for a specific rule in the law.
When the labor department finds an uncorrected wage-law violation, it must order the employer to pay assessed amounts. The order becomes final unless the employer appeals in writing within 20 days after it is sent. A hearing must happen within 30 days after an appeal, and a decision must follow within 30 days after the hearing ends. Before the order is final, the director may change it or reduce a penalty for good cause if the employer complies. The director may file a final order in court, where it becomes a judgment that cannot be appealed.
