Beginning July 1, 2025, officers overseeing contested Idaho agency cases can issue subpoenas requiring witnesses to attend or provide records. A party can request a subpoena, or the officer can act on their own. The evidence must be generally relevant to the hearing, and the request must have a reasonable scope. Service follows civil court rules unless another law or agency rule says otherwise. The requesting party pays witness fees under civil court rules. District courts can review, set aside, change, or enforce subpoenas. The court must be where the inquiry occurs or where the subpoena recipient lives or does business. Disobeying a court order can lead to punishment for contempt.
