2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Groundwater districts can add election divisions

Beginning July 1, 2025, Idaho groundwater district boards can add election divisions and precincts after adding land to the district. Boards must find this serves the district’s best interest, and new divisions must follow Idaho Code section 42-5208. When adding a division and reallocating representation, boards must issue an order redrawing divisions. Board minutes must identify the division and precinct assigned to the added land. Added land is subject to assessments for benefits it receives from joining the district.

Later groundwater liens with mortgage priority

Effective July 1, 2025, groundwater assessment liens attach February 1 instead of January 1; assessments against municipalities are excluded. These liens cover land tied to the water rights used to calculate the assessment. They outrank mortgages and deeds of trust, regardless of recording date, if delinquency notice is sent to the lender at least 60 days before foreclosure sale. Liens remain until paid, and foreclosure buyers remain responsible for later assessments; other Idaho water liens are unchanged. Treasurers must enter overdue assessments by February 15 instead of January 15, dated February 1 instead of January 1. They must file certified delinquency lists with county recorders and mail notices to affected groundwater users. They must also record paid-in-full notices with county recorders monthly. The law does not change assessment amounts.
