Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 1 costs, 2 mixed.

Drug lab homes must stay vacant

Idaho police must notify owners and the health department within 72 hours of finding drug lab indicators, using an approved form. Police must post a warning sign, and the home must stay vacant from notification until the department issues a delisting certificate. Owners must meet cleanup standards or choose demolition; the department lists sites reported by police or voluntarily by owners. For cleanup, owners must submit an original or certified final report with property details, sampling methods, results, hygienist qualifications, and signed cleanup certification. The department issues a dated delisting certificate after a qualified hygienist confirms cleanup or the owner documents complete, lawful demolition and disposal.

Drug lab cleanups require independent testing

Idaho sets the methamphetamine cleanup limit at 0.1 microgram per 100 square centimeters. Porous surfaces at or below 0.5 microgram per 100 square centimeters may meet the standard with an appropriate coating or sealant. Other drug limits are set case by case after reviewing a chemical inventory and consulting the department, owner, police, and hygienist. A qualified industrial hygienist, independent of both cleanup and testing companies, must collect clearance samples using required documentation and handling procedures. These include room-by-room sampling, photos, floor-plan mapping, numbered locations, gauze wipes, sample tracking, and separate samples in highly contaminated areas. A laboratory certified by the Environmental Protection Agency or accredited by the American Industrial Hygiene Association must analyze the samples for the substance.

State lab customers face testing fees

The Idaho State Laboratory may charge market-rate fees for testing services. Its rates must not disadvantage other entities offering similar services. The law sets no specific testing price.
