The county where an illegal drug ad violation occurs receives 90% of collected fines for its sheriff's office. The county's district court fund receives the remaining 10%. Funding depends on how much fine money is collected; the law sets no total dollar amount.
Effective immediately upon passage and approval, the law bans willfully publishing commercial ads in any medium within Idaho for illegal drugs. It covers marijuana, narcotics, and other mind-altering substances only when illegal both in Idaho and where provided. Commercial ads encourage consumers to use products or services for a business's benefit. Each violation is a misdemeanor with a $500 fine. Each day a violation continues counts as a separate offense.
