Idaho-licensed brewers making fewer than 30,000 barrels yearly qualify for retail licenses; outside-Idaho and contract production count toward that limit. They can sell their own beer by bottle, can, or glass at the brewery, one remote location, or both. Brewers exceeding the limit need annual approval and at least five years of continuous brewing and physical presence in Idaho. They must also surrender any wholesale license and have no multi-day license suspension or revocation for a beer-law violation. Holding a wholesale license does not itself block brewery-premises retail wine or wine-by-the-drink licenses for brewer retail license holders.
Brewers making fewer than 30,000 barrels yearly can get wholesale licenses to distribute their own beer. The total includes beer made outside Idaho and contract production. Brewers must maintain an Idaho warehouse and distribute using brewery employees and equipment the brewery owns or controls. They must follow wholesaler rules, except rules restricting sales at the brewery or its one remote retail location. No extra wholesale license fee applies beyond brewer and retailer fees; applicable beer taxes still apply.
Wholesalers and dealers must unload and keep beer in an Idaho warehouse for at least 24 hours before selling or distributing it. Required records must stay in Idaho at the designated main warehouse. The law preserves existing rights of anyone licensed as an Idaho wholesaler on or before January 1, 1996. The act took effect immediately upon passage and approval.
