Bill Overview

Analyzed Economic Effects

5 provisions identified: 0 benefits, 2 costs, 3 mixed.

Parents get support reviews with limits

Beginning July 1, 2025, Idaho tells parents with state-enforced support orders about their review rights every 36 months. A parent or state, tribal, or foreign child support agency can request a review. Reviews are automatic at least every 36 months when either parent receives assistance under the federal cash-assistance law. More frequent reviews require a substantial and material change in circumstances. Idaho can seek a payment change only when the difference is both at least 15% and $50 per month. A qualifying change can raise or lower support.

Overdue support affects parents' credit records

Beginning July 1, 2025, Idaho must report qualifying overdue child support to credit reporting agencies. The parent must owe more than $2,000 and be at least three months behind after the court order becomes final. Idaho must notify the parent first and explain how to challenge errors. Reporting can affect the parent's credit record and access to credit.

Parents face child health coverage requirements

Beginning July 1, 2025, when medical-support rights are assigned to Idaho, the state must seek court-ordered coverage for the child. This covers available job-based or other group insurance through either parent, and Idaho must act to secure and maintain coverage. Parents have 20 days after an intent-to-enroll notice is mailed to request an administrative review. Idaho must cancel enrollment notices when no medical support is owed or required, or either parent already provides qualifying non-Medicaid coverage.

Idaho keeps support for foster-care costs

Beginning July 1, 2025, Idaho must keep collected child support when it seeks repayment for foster-care assistance, care, or placement. That money repays the state instead of going to the person owed support, leaving less for that household.

Parents face child support service fees

Beginning July 1, 2025, Idaho charges $25 before providing child support services. It charges another $25 each time support is collected through an income tax offset. A $35 annual fee applies per case when Idaho collects and pays out at least $550 during the federal fiscal year. The law also voids the prior Child Support Services rules, IDAPA 16.03.03, on that date. The repeal alone does not specify which services or household duties change.
