Beginning July 1, 2025, Idaho agencies must check lawful presence for adults 18 or older seeking state, local, or federal public benefits. The law removes several exceptions, including when lawful presence is not otherwise required or federal law exempts the applicant. Exceptions remain for emergency medical care unrelated to organ transplants and short-term, noncash disaster relief. A narrower shelter exception covers in-kind services at short-term shelters needed to protect life or public safety. Those shelter services cannot base aid on income or resources.
Beginning July 1, 2025, Idaho's public assistance department loses express authority to include lawful presence in its residency requirements. This limits the department's authority, but does not end the separate benefit-verification rules. It does not automatically make applicants who lack lawful presence eligible for benefits.
