Beginning July 1, 2025, foreign principals from designated foreign adversary countries cannot buy, hold, rent, or control property inside Idaho's defined military-area boundary. Those already controlling covered property must sell or otherwise give up control within 180 days after July 1, 2025. Later acquisitions through inheritance, enforcement of a security interest, or debt collection require giving up control within 180 days of acquisition. For missed deadlines, the attorney general must sue, and the court must order a foreclosure sale. Foreign pension funds and federally cleared entities with a national security agreement in place by July 1, 2025, are exempt.
Beginning December 28, 2025, anyone can report violations of Idaho's foreign property-control restrictions to the state attorney general. You qualify for a reward if your report leads to the required sale or transfer of illegally held assets. The reward equals 30% of land-sale proceeds remaining after sale costs, approved state investigation and court costs, and valid liens. Any proceeds left after the reward go to the restricted foreign entity.
Beginning July 1, 2025, people and entities that are not foreign entities have no duty to check another party's status. They do not have to determine whether Idaho's foreign property-control restrictions cover that party. They also cannot face civil or criminal liability under this section.
