Highway misdemeanor rule covers fewer people

Beginning July 1, 2026, Idaho’s highway-law misdemeanor rule expressly covers elected officials and officers, rather than any person. It applies when they violate or help violate the highway title and no different penalty is set by law. The maximum penalty is a $1,000 fine, 90 days in jail, or both. Fines go to the state highway distribution account. This change narrows this specific penalty rule; other laws can still apply to other people.

More bike and walking project options

Beginning July 1, 2026, Idaho highway agencies gain another way to include new or existing bike and walking facilities. In highway or bridge projects mainly benefiting motor vehicles, those facilities can qualify through federal funds or grants for that purpose. County commissioners gain the same federal-funding option for highway projects. Existing allowances remain: secondary benefits, federal-law compliance for agency projects, and county safety improvements near schools, parks, or designated areas. The law does not award money or require a project.
