Beginning July 1, 2025, Idaho penalizes repeated meritless nuisance complaints against the same agricultural operation. A complaint is meritless when it alleges a public or private nuisance while the operation complies with Idaho’s right-to-farm law. Covered complaints go to the Idaho Department of Agriculture, Department of Environmental Quality, Department of Lands, or another state or local law enforcement agency. Within two years of the first complaint, a second meritless complaint is an infraction with a $150 fine. A third brings a $300 infraction fine; a fourth or later meritless complaint is a misdemeanor.
Beginning July 1, 2025, Idaho’s law protects agricultural operations, facilities, and expansions from public or private nuisance claims. Protection applies when they follow generally recognized farming practices or comply with a state or federal permit. It does not cover nuisances caused by improper or negligent operation. In nuisance cases against farm owners, operators, or landowners, prevailing owners or operators are entitled to reasonable lawyer fees and costs. The court must find they won because the operation followed Idaho’s right-to-farm law, and the losing party must pay.
