Fast abortion lawsuit dismissal and legal costs

Beginning July 1, 2025, defendants in Idaho’s private abortion-enforcement lawsuits can request fast dismissal through a special court motion. They must file within 60 days after being served, unless the court allows more time for good cause. Filing generally pauses the case through the ruling, appeal deadline, and any appeal. Limited evidence gathering is allowed when needed to decide the motion and the information is not reasonably available otherwise. Courts must hold a hearing within 60 days of filing, unless necessary evidence gathering or good cause requires more time. Courts must rule within 60 days after the hearing. Defendants can appeal a denial within 42 days. The court must award the motion’s winner court costs, reasonable lawyer fees, and reasonable litigation expenses, exposing the loser to those costs. A plaintiff who voluntarily drops the case does not prevent a ruling on the motion or recovery of costs and fees.
