Idaho sets decision deadlines for applications to create agricultural protection areas or add land to existing ones. County commissioners or their appointed administrator must approve or deny applications in writing within 60 days after receiving the commission’s recommendation. The decision must identify the ordinance and standards used, the recommendation, and steps the applicant could take to gain approval. It must also include the administrator’s reasoned explanation, when applicable. Without a timely written decision, the commission’s recommendation becomes the decision—not automatic approval. Applicants challenging a decision have 30 days after receiving the written decision or the recommendation that becomes final to appeal to the county board. The board must hold a public hearing within 60 days after receiving the appeal, following required notice and hearing procedures. It must consider the recommendation, the administrator’s decision, all written and spoken public comments, and other information it finds relevant. The board must issue its final decision within 60 days after the hearing closes; otherwise, the administrator’s decision becomes final. The final board decision is subject to court review. Approval creates the agricultural protection area.
