Stronger privacy for people in mediation

Beginning July 1, 2026, mediators in Idaho must keep mediation details private. They cannot give reports, opinions, or recommendations to a court or agency that could decide the case. They may share only three things. First, they may say whether mediation happened or ended, who attended, and whether there is a settlement. Second, they may share a communication that Idaho Code 9-806 allows. Third, they may report messages showing abuse, neglect, abandonment, or exploitation to a protection agency. The law removes any allowance to disclose under Idaho Rule of Civil Procedure 16(j). If someone breaks these rules, a court, agency, or arbitrator cannot use that communication.
