Mediators face stricter disclosure limits
Beginning July 1, 2026, mediators cannot send reports, recommendations, or evaluations to a court or agency. This ban applies to any authority that may decide the dispute. They can say if mediation happened or ended, who attended, and if there was a settlement. They can share communications allowed under Idaho Code 9-806. They can also report abuse, neglect, abandonment, or exploitation to the agency that protects people. In mediations under Idaho Rule of Civil Procedure 16(j), they can share what that rule allows. Courts, agencies, and arbitrators cannot use mediator communications that break these limits.
