Extra pension after returning to work

If you return for under 48 months, you get a supplemental annuity based only on pay and time from that return period. Your full career still counts to meet any minimum service rules. If you return for 48 months or more, the Fund uses a combined formula. It counts all service, then subtracts the value of payments already made and the suspended amount. The extra piece cannot be smaller than the under-48-month method. Your original annuity restarts with all increases due. For under 48 months, later increases use the original annuity’s effective date; for 48+ months, increases use the supplemental annuity’s effective date.

Retirees back at covered jobs: payments stop

If you get a retirement annuity and return to a job that makes you a participating employee, your payments stop. The stop starts the first day of the month on or after your start date. You count as participating if you work over 599 hours in a year. If your employer passed a resolution, the trigger is over 999 hours. School security guards under Section 7-142.1 use over 999 hours. The year for counting hours starts on the month and day you first return after retirement. Some people are allowed to keep payments under Section 7-137.1(b). You can apply to restart payments after you again qualify.

Tier 2 retirees face stricter work rules

If you are a Tier 2 retiree and take full-time work in another pension system under this Code, your annuity stops while you work. If you first joined on or after January 1, 2012 and take a contract with your former government employer, your annuity also stops during that contract. You must tell the Fund and the contracting employer before you accept. If you do not, it is a Class A misdemeanor and a $1,000 fine. When the job or contract ends, your annuity resumes and is recalculated.

Tracking and employer payback for overpayments

The Fund tells every retiree at retirement and each year to report any return to work. It keeps a tracking system and reminds employers and retirees each year about return-to-work limits. If an employer knowingly fails to tell the Board to stop payments, it may have to repay up to half of the payments made after the stop date. No employer payback applies if the retiree worked there less than 12 months. Total repayments from the retiree and employer cannot be more than the overpaid amount.
