Owners of public facilities or multi-story housing in violation face civil fines up to $250 per day. Each day is a separate offense. Fines keep adding up until the building complies.

License risks for architects and engineers

Architects and engineers who certify a noncompliant plan face license discipline. The state can suspend, revoke, or refuse to restore a license. Losing a license can stop you from working and cut income.

Fines for officials issuing illegal permits

A person who knowingly issues a building permit that breaks this law faces a civil fine up to $1,000 per offense. Each improper permit is a separate offense. This targets officials who approve illegal construction.

Stronger enforcement of building accessibility

The Attorney General enforces the Environmental Barriers Code. The AG can investigate complaints, take sworn statements, issue subpoenas, and hold hearings. The AG can ask courts to stop illegal construction and order compliance. The AG can settle cases with an Assurance of Voluntary Compliance. A building stays in violation after work is done until it meets the Code.
