The law lets Lake County, Lindenhurst, and Joliet dissolve specific sanitary districts and take over service. Lake County can dissolve the Fox Lake Hills district by resolution that states reasons, addresses debts, protects permits and grants, and takes all assets and duties. Lindenhurst can end the district’s board by ordinance and use its taxing power; later it may dissolve the district once debts are cleared or funded, with the same statements. The Southeast Joliet district can dissolve if its board passes a resolution and Joliet accepts within 14 days; Joliet takes assets and duties, and unneeded assets go to Will County. Each dissolving government must notify the Illinois Environmental Protection Agency within 60 days after its action takes effect.
Any sanitary district with no unpaid revenue bonds can go to a public vote on dissolution. At least 50 voters who live in the district must file a petition with the county circuit clerk. The court sends the question to election officials, and the ballot asks: “Shall the sanitary district of ____ be dissolved?” If a majority votes Yes, the court dissolves the district. The court orders the district to pay its remaining obligations.
