Stronger tracking of stolen and crime guns

Beginning January 1, 2026, court clerks must send the gun’s serial number with final case results to the Illinois State Police when a gun is alleged in a crime. If the serial is removed, clerks must send the information the State’s Attorney provided. At sentencing, judges must say if a gun listed as stolen in the ISP database was used. If the court finds a stolen-listed gun was used, the clerk must report the conviction to the ISP Division of Justice Services within 5 days. Beginning January 1, 2026, the ISP analyzes statewide data on stolen or serial-removed guns, posts it online, and sends a report to the Governor, Attorney General, and General Assembly.

New review and court rules for FOID

By January 1, 2026, the FOID Review Board must set up a process for people covered by subsection (f) to seek relief. If the Board denies relief under subsection (f), the circuit court reviews the case anew (de novo). Other final Board decisions still use the Administrative Review Law. Expedited decisions can be reviewed by the Illinois State Police or the person seeking relief. Board members and Illinois State Police staff who take part in this process are immune from damage lawsuits over FOID grant, denial, renewal, revocation, suspension, or failing to act on those decisions.
