Faster behavioral health contracting and coverage

Beginning January 1, 2027, insurers must finish credentialing and contracting within 60 days of a completed application. Services given from the application date to the contract start can be paid at the contract rate, with claims submitted after the contract starts and notice to the patient. Plans must cover all medically necessary same‑day mental health or substance use services, even from different providers. Supervised trainees are covered, and their services must be billed under the supervisor’s NPI. Applicants in a group practice who are fully licensed and working under a participating supervisor are covered up to their contract start, billed under the supervisor’s NPI. Plans must cover 60‑minute psychotherapy (CPT 90837) without extra paperwork or audits, and insurers must share and post credentialing rules and contact info.

Enforcement, fines, and timelines for parity

Starting June 1, 2026, the Department of Insurance enforces these rules and may fine $1,000 per violation after notice and a hearing. The Department must adopt implementing rules by September 1, 2026. It must review impacts about 2, 7, and 12 years after implementation and report by December 31, 2030, 2035, and 2040. Reviews examine out‑of‑network use, out‑of‑pocket costs, premiums, and network adequacy.

Higher in-network pay for mental health care

Starting January 1, 2027, health plans must pay at least a set minimum for in-network mental health and substance use care in Illinois. The floor uses an April 2024 RTI study method and Illinois data, across inpatient and outpatient billing codes. This applies when policies are amended, delivered, issued, or renewed on or after that date, including plans run by third-party administrators. This can improve access but may raise insurer costs and premiums.

Post‑mastectomy benefits for public employees

Beginning June 1, 2026, self‑insured counties and municipalities must cover post‑mastectomy care and other required benefits. Insurance for school employees must also include these benefits. Home‑rule entities must comply. The Illinois Department of Insurance enforces these rules.

Medicaid and CHIP plans are excluded

Beginning June 1, 2026, these new parity and coverage rules do not apply to Medicaid or CHIP plans. If you are in Medicaid or CHIP, your plan is excluded.
