No civil arrests near Illinois courts

People attending a State court proceeding in good faith are protected from civil arrest at the courthouse, on courthouse grounds, nearby sidewalks and streets, and on any public way within 1,000 feet. If someone unlawfully makes a civil arrest and knew or should have known you were there for court, you can recover your actual damages plus $10,000 in statutory damages, and get costs and reasonable attorney’s fees. Courts can issue orders to protect this no‑arrest rule and keep court business running. The law shields court system staff acting lawfully from suit.

Hospitals add privacy rules on enforcement

Hospitals must adopt and submit policies for handling law‑enforcement interactions by January 1, 2026 (general acute care) and March 1, 2026 (others). Policies verify agent identity, control access, protect patient privacy, and only allow immigration‑related disclosures with a valid federal subpoena, order, or warrant; staff receive training and language access is addressed. Hospitals must post a notice with a phone number to learn about immigration rights in the main local languages. The Department of Public Health can investigate complaints and, after a 7‑working‑day cure period, fine up to $500 per day for missed filings (notices by January 15 or March 15, 2026). The University of Illinois Hospital must follow these rules, and the Department can use emergency rulemaking for six months to roll them out.

Colleges limit sharing immigration status

Public colleges cannot disclose or threaten to disclose immigration or citizenship status without consent, unless required by law or court order, and cannot list it as directory information. By January 1, 2026, schools set procedures to review and log law‑enforcement entry requests, name a contact, and post clear rights resources and contact information online. Starting January 1, 2026, anyone harmed by an unlawful disclosure can sue within two years of the violation or discovery; courts may award actual damages for willful violations, stop the practice, and grant reasonable attorney’s fees and costs.

Day cares protect family immigration privacy

Licensed day care centers cannot share a child’s or family member’s immigration or citizenship status unless the law requires it. Centers must adopt policies and train staff by January 1, 2026, set a primary contact, handle warrants and subpoenas, seek parent notice or consent for records unless a judicial warrant applies, update emergency contacts every six months, and notify parents and the Department if enforcement occurs on site. If a parent faces immigration enforcement, the center must release the child to listed emergency contacts or to someone with a valid short‑term guardian form. Breaking the disclosure ban is a licensing violation.

New right to sue immigration enforcement

The law creates a state cause of action when someone, while doing civil immigration enforcement, knowingly violates the Illinois or U.S. Constitution. You can seek money damages, court orders, and declarations, and the court must award reasonable attorney’s fees and costs if you win. Defendants can raise qualified immunity. When courts consider punitive damages, they must weigh factors such as wearing a face covering, failing to identify as law enforcement, not using a required body camera, using crowd‑control gear, operating a vehicle without Illinois plates, or violating court orders.
