Schools must report gun incidents publicly

Superintendents must report verified firearm incidents at school or on school property to local police right away when they get a written, electronic, or verbal report from staff. Schools must also report verified firearm incidents through the State Board of Education’s systems as they happen and by July 31 for the prior school year. The State Board publishes the data by school district on its website. Local police must send prior‑year incident data to the Illinois State Police by March 1 for the annual Crime in Illinois report.

Police detain minors with guns at school

If a minor is found with a gun on school grounds, local police must detain the minor. Police hold the minor until required juvenile determinations are made. If police have probable cause the minor broke the listed gun law at school, they must process the case under juvenile procedures.

School staff must report guns and threats

All school employees must tell the principal right away if they see or learn of a gun on school grounds or a threat of gun violence. They can delay only if speaking up would put students they supervise or themselves in immediate danger, and must report as soon as it is safe. After a report, the principal must call local police immediately. If a student is involved, the principal must also tell the parent or guardian. For a student threat, the school must try to reach the parent quickly so the parent can help make sure the student has no access to a gun. Reporters who act in good faith are protected from lawsuits and criminal charges, and schools cannot share a reporter’s identity unless the law allows. Knowingly failing to report is a petty offense; a second or later offense is a Class C misdemeanor. These rules cover public and private K-12 schools. “School grounds” includes school property, school transport vehicles, and public ways within 1,000 feet of school property.
