Employer keeps paying your health premiums

While you are on active duty, your employer must keep your health plan in place and keep paying the employer share of the premium and admin costs. This helps you avoid gaps in coverage and extra out‑of‑pocket costs.

Full public pay for training days

You keep your full public‑employee pay for up to 30 days each year while on annual training or orders in lieu. You can use both types in the same year, but together they cannot exceed 30 paid days. These paid days can be taken at different times.

Job and leave rights for public service members

The law applies federal USERRA job and reemployment rights to Illinois public workers in military service. You do not need employer permission for military leave; you only give advance notice, and employers cannot add extra conditions. You may choose to use accrued paid leave during duty, and your employer cannot force you to use it. Time on duty counts for seniority and promotion. During leave, you get at least the average of your last three ratings, and not less than your last rating. Probation is excluded. If a disqualifying discharge is later upgraded, your reemployment rights are restored if you meet the rules.

Localities pause extra benefits at 20% mobilization

If 20% or more of a local government’s workers are mobilized at once under certain federal laws, the employer is not required to provide extra benefits under this section unless funding is provided. Extra benefits can pause when a large share of staff is called up and no money is set aside.

Differential pay rules for public workers

The law pays differential pay when you are on covered military duty, only for days you would have worked. Your daily public pay is your pay for the period divided by work days. Your military daily pay is base pay divided by calendar days in the month; drill uses the drill-pay chart. You may choose to use accrued paid leave instead of differential pay. After you use your 30 days of concurrent pay, you can still get differential pay later in the year if the law allows. For voluntary active service, differential pay is capped at 60 work days each year. There is no differential for unpaid duty, including travel to and from orders and rest periods. If you are away for 3 straight years on voluntary active service, your right to differential pay ends and returns after you work more than 90 days.
