Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Faster ballistics testing for crime guns

If police recover fired cartridge cases or a NIBIN‑suitable semiautomatic gun tied to a crime or unlawful possession, they must submit it for NIBIN processing. Labs with NIBIN access aim to enter evidence and test fires within 2 business days of submission, when practicable. Labs without access must send the items to a lab that has it; that lab aims to enter within 2 business days when practicable. If other forensic tests are needed, agencies, labs, and the court weigh delays against the 2‑day goal.

More federal agents count as peace officers

The law expands who counts as a peace officer in Illinois. It includes certain federal officers with arrest or public‑order duties, such as DHS, USCIS, Coast Guard, CBP, and ICE. This status applies when Illinois laws rely on the term peace officer.

Stronger gun tracing and sharing rules

Police who seize or recover a gun must trace how the person got it. They must do this when the gun was unlawfully possessed or used, found at a crime scene, or appears lost, stolen, or abandoned. For guns tied to a felony or unclaimed, police also try to find prior owners. Agencies must use the ATF National Tracing Center and FBI NCIC, and use ATF eTrace. They must join eTrace data sharing so trace reports are shared across Illinois. All stolen, seized, or recovered guns must be entered in the LEADS Gun File.
