The Illinois Attorney General enforces this law and can write rules to carry it out. The office must take complaints from the public and hospitals and handle them. The Attorney General can investigate, issue subpoenas, take testimony under oath, and review records. If there is a likely violation, the Attorney General can seek court orders to stop it and may approve a hospital’s Correction Plan before suing. Civil penalties can be up to $500 per violation for pattern failures to give required information, and up to $1,000 per violation for other listed failures. Money paid under court orders or plans goes to a special fund for enforcement and public education, as allowed by law. After a final court order and all appeals, the Attorney General can refer a hospital to the Health Department for possible licensure action.
Hospitals that charge a separate outpatient facility fee must tell patients as soon as reasonably practicable. The policy must say how notice is given. It must list what services and costs the fee covers. It must explain why the fee is charged to you or your plan. It must give contact information for more details.
