Beginning January 1, 2026, if the Department denies a discharge or transfer, it issues a written denial. When the denial is for failing to readmit after a hospital stay or absence, the Department orders immediate readmission. The facility must comply. If it refuses, it is fined $2,500 per occurrence. After readmission, the facility must tell the Department within 10 business days, send required documents, and reassess care needs to update the plan.
Beginning January 1, 2026, facilities must give at least 21 days’ written notice before an involuntary discharge, not 30. Emergency or safety moves can still happen faster. If you request a hearing in time, the discharge is paused until the hearing or appeal ends, unless an emergency or safety reason arises. Even after an authorized discharge, you cannot be required to leave before day 34 after notice or day 10 after the decision, whichever is later.
Beginning January 1, 2026, a doctor must complete a full assessment before admission to assisted living or shared housing. Residents are reassessed each year and after a big change, including new Alzheimer’s or related dementia. The Department may require more frequent skin and nutrition checks by rule. A written service plan must reflect your preferences and be given to you or your representative on request.
