More people can enforce these rights in court, including neighbors within 500 feet, governments, and qualified nonprofits. Courts can order injunctions, specific performance, and damages against owners or others who violate the right. If you willfully violate a conservation right, the court may also add punitive damages up to the full value of the property. Effective July 26, 2019.
Illinois law creates a “conservation right” on real property. It can be a restriction or easement recorded on your deed. It protects historic buildings, natural areas, and cultural or archaeological sites. These rights run with the land and bind future owners. Effective July 26, 2019.
You can grant a conservation right to a government, a federally recognized tribe, or a qualified nonprofit. It takes effect only after the grantee accepts it, and the grantee can require you to fund management. Rights can be recorded and transferred to eligible holders, or released back to the fee owner by agreement. After the first recording, no extra filings are needed to keep it valid. Effective July 26, 2019.
Any change to a conservation right must be in writing, signed by both sides, and recorded with the county. Either side can refuse to amend. Changes cannot harm the conservation purpose or help end the right. Effective July 26, 2019.
