Transportation Department rule limits and notice

The Department must adopt rules to carry out this law, but it cannot make Section 6’s standards stricter. The Illinois Administrative Procedure Act applies. Mailing notice to a party’s address of record counts as proper notice.

Appeal rights and fast final decisions

If the Department denies, revokes, or fails to act, you can request an administrative hearing within 30 days. Hearings usually start within 30 days unless extended. After the final hearing, the judge sends findings to the Secretary in 30 days. You may respond in 30 days; the Department may reply in 30 days. The Secretary issues the final order within 60 days after the judge’s report, and that is the Department’s final decision. To challenge it in court, file in Sangamon County or Cook County under the Administrative Review Law.

Register highway signs and add ID tags

You must register each outdoor sign that drivers can see from a highway, unless it is an exempt type. You pay $5 per sign to register. The Department may ask for landowner information and a consent statement. The Department gives you an ID tag for each registered or permitted sign. Put the tag on the front of the sign within 60 days of getting it (or when a new permitted sign is finished, or within 10 days of getting the tag). Keep the tag visible and attached.

Permits and fees for new highway signs

You must get a state permit before putting up a non‑exempt highway sign. Permit fees are $50 for signs under 150 sq. ft., $100 for 150 to under 300 sq. ft., and $200 for 300 sq. ft. or more. The Department reviews your application within 45 days, tells you any problems, you get 45 days to fix them, and it makes a final decision within 30 days after your fixes. If denied, the Department must explain the laws it relied on. In airport‑zoned areas, review takes longer and also needs airport approval, but the Department continues its own review.

Simpler digital upgrades for existing signs

If you already have a legal permitted sign, you can upgrade it to a digital, multiple‑message display without getting a new sign permit. File a permit addendum and pay a nonrefundable $200 fee. The Department cannot ask again for surveys or other documents already on file. This option does not apply to legal nonconforming structures.

Transfer permits after sign ownership changes

When a sign changes owners, the new owner must notify the Department and provide required information within 120 days. The Department confirms receipt within 14 days and completes the transfer at no cost within 60 days after it has all information. If the Department asks the transferee for missing items, the transferee has 30 days to respond. If required information is not provided within 120 days, the permit may be revoked.

Municipal network signs: waivers and deadlines

For municipal network signs, the Department waives state rules when that does not conflict with the federal Highway Beautification Act. Municipal applications pending on May 1, 2013 that do not need federal changes must be issued within 10 days after this law takes effect. The rest of the pending municipal applications must be finished within 30 days. If USDOT or a court later finds a permit breaks federal law, the permit is void.
