You cannot be jailed in these municipal code hearings. A hearing officer cannot fine you more than $50,000 per case. Your city can choose a different cap, but it cannot be higher than the Mandatory Arbitration System maximum for your judicial circuit. The cap excludes enforcement or remediation costs and does not apply to municipal tax collection cases.
A municipal code case starts when an authorized city official files a written pleading. Hearing officers can order you to stop violations and fix problems by a set date. If you do not, the city can do the work and bill you for the costs.
If your city uses administrative adjudication, it must set up a code hearing unit and list which violations it can hear. Hearings are run by hearing officers who are Illinois lawyers with at least three years of experience. They must complete formal training before hearing cases; former Illinois judges are exempt from that training. Hearing officers can take testimony, accept evidence, issue subpoenas on request, keep the record, and issue written decisions with findings and orders.
