Family approval before moving dementia residents

Nursing homes and long-term care facilities cannot make big, disruptive changes or move a resident with dementia or reduced decision-making capacity without prior approval from a family member, guardian, or power of attorney. This protects residents and families from sudden relocations and service changes.

No discriminatory insurance rates or treatment

Insurers cannot treat people differently because of race, color, religion, or national origin in many types of insurance. Auto insurers cannot charge higher premiums because of a driver’s disability or those protected traits. These rules cover both pricing and underwriting.

Stronger protections on senior insurance sales

The law sets guardrails for selling accident or health insurance to people 65+ and nursing home residents. Sellers must tell you to review your current plan and talk with a family member or advisor, then wait 48 hours before making changes. They must give a phone number for questions and let you opt out of future contacts. If you are over 65 with a health care power of attorney or reduced capacity, your agent must sign and the agreement must be in writing. The Department of Insurance can hold a hearing and void policies made in violation of these rules.

Tougher enforcement of unfair insurance practices

The law bans insurer agreements that boycott, coerce, or intimidate and harm competition. Acts already barred in law now clearly count as unfair or deceptive insurance practices. Insurers that often ignore the Unclaimed Life Insurance Benefits Act also commit an unfair practice. Regulators can use these rules to protect consumers and beneficiaries.
