Beginning January 1, 2024, any single, connected area with at least 300 people can form an emergency services district. The area cannot be inside a fire protection district that provides rescue, unless the new district only runs ambulances there. In that case, the fire district’s board must vote to end its ambulance tax levy, and the new district must serve that area with its own ambulances. The district’s board can run ambulance and rescue services, borrow money, pledge or mortgage district property, buy equipment and land, and hire or contract staff and set their pay.
Beginning January 1, 2024, forming a district requires a petition signed by at least 5% of legal voters in the area, with at least 25 signers. If the area spans more than one city or includes unincorporated land, at least 5% of voters in each part and in the unincorporated area must sign. The court must publish notice once a week for two weeks; if no newspaper exists, it must post notices in at least 10 public places at least 10 days before the hearing. A hearing must occur within 20 days of filing so residents can be heard and boundaries can be set. If the court adds new territory, it must publish notice at least twice, at least 10 days before another hearing held within three weeks; the schedule must allow the question on the next general election ballot.
