On-farm poultry exemption up to 5,000 birds

The law lets small poultry raisers sell birds they raised without continuous inspection, up to 5,000 birds a year. Sales must be on or from your premises—at the farm, farmers’ markets, roadside stands, or by delivery. Apply in writing; the exemption starts when the Department sends written notice and lasts two years unless revoked. Processing must be on‑premises, sanitary, and open to periodic Department checks, with one responsible person certified as a Food Protection Manager. Labels must show your name and address, the processing date, and "NOT INSPECTED‑Exempt P.L. 90‑492" in at least 10‑point type, and you must post an 18‑point point‑of‑sale notice or online message. At farmers’ markets, give safe‑handling instructions, keep required temperatures under Section 3.3, and seal products in watertight packages. Keep records proving you stayed under 5,000 birds and retain them for one year after each exemption; ads must state the products are exempt.

Exemption for meat raised for family

The law exempts people who raise animals or poultry on their own farm for personal or family use. You are not exempt if you buy or trade animals, run a slaughter business, prepare meat for sale (canning, curing, pickling, freezing, salting, or other prep), or allow slaughter of animals you do not own for more than 30 days.

Retail butchers exempt for simple cutting

The law exempts retail dealers and butchers when they only cut up already‑inspected meat or poultry and sell it directly to consumers in a retail store. The cutting must be incidental to running the store; any other processing or preparation is not covered.
