Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 0 costs, 2 mixed.

Fines and refunds for unauthorized reservations

Violators face civil fines up to $1,000 for each day they break the law; each day counts as a separate violation. The Illinois Attorney General can sue to collect fines or restitution. Restaurants and people charged unlawful fees can sue in Illinois circuit court. You can ask a judge to stop the practice, get back up to the total fees the site collected, and recover attorney’s fees and costs. You must file within one year of the violation.

Restaurants must OK online reservations

Third-party reservation websites and apps must have a written deal with a restaurant before listing its reservations. The rule applies to sites and apps that arrange on‑premises reservations and are not owned by the restaurant. It covers places that serve food in single portions, whether eaten on‑site or taken to go, including pushcarts, stands, and vehicles. Services already authorized by the restaurant under a contract are allowed.
