The law lets prescribers write epinephrine prescriptions to a group or an authorized person. These prescriptions last 2 years. The Department can issue a statewide standing order so trained staff can get and use epinephrine. Authorized groups or people can stock undesignated injectors and must store them where they are easy to reach in an emergency. Using an undesignated injector under this law is not practicing medicine, and there is no limit on how many injectors they may keep.
A trained authorized person may give or use an epinephrine injector when they in good faith think someone has anaphylaxis on the property. They can hand it to the person or to a parent, guardian, or caregiver for immediate use. You must finish an approved anaphylaxis course before giving an injection; training lasts 2 years and can be online or in person. Courses teach how to spot anaphylaxis, how to use an injector, and include a test; a certificate is issued, and the Department lists approved programs. If you act in good faith, you are protected from most lawsuits for the act of giving or using the injector, except for willful and wanton misconduct.
The group that starts the process to get undesignated epinephrine injectors and arrange training must pay those costs. The law does not set prices or fees. People who receive care do not pay under this rule.
