Beginning January 1, 2024, you pay no more than in-network amounts for emergency care, even if the ER or doctor is out of network. When you use an in-network hospital, and an out-of-network specialist (like anesthesia, radiology, pathology, or neonatology) treats you, your costs are the same as in-network. Your copays, coinsurance, and deductible are calculated as if the provider was in-network. This protects you from surprise higher bills after emergencies or hospital visits.
Beginning January 1, 2024, the law clarifies what counts as your cost sharing: copays, coinsurance, and deductibles. It excludes your premiums, balance bills, and costs for services your plan does not cover. The law also defines "ancillary services," including anesthesiology, radiology, pathology, neonatology, hospitalists, assistant surgeons, intensivists, and most diagnostic tests. These definitions make clear which services must follow the in-network cost rules when an out-of-network clinician treats you at an in-network facility.
