To apply, pay a $150 filing fee and submit wage records for the past calendar year. List every employee by gender and by race and ethnicity as on your most recent EEO‑1, plus county of work, start date, and total wages rounded to the nearest $100. Include any other information the Department requires. Also submit a signed Equal Pay Compliance Statement from a corporate officer, legal counsel, or authorized agent. It must certify compliance with federal and state equal‑pay and anti‑discrimination laws, and that women and minority workers are not paid less than comparable workers in each major EEO‑1 job category after considering tenure, job needs, experience, skill, effort, responsibility, working conditions, education or training, location, and collective bargaining.

Large employers must get equal pay certificate

Private businesses with 100 or more Illinois employees that file the federal EEO-1 must hold an Equal Pay Registration Certificate. Businesses authorized on March 23, 2021 must apply between March 24, 2022 and March 23, 2024, then recertify every two years. New businesses authorized after March 23, 2021 must apply within three years of starting and not before January 1, 2024. Any business authorized after the law takes effect must send contact information to the Department by January 1 of the next year. The Department assigns each business its application and two‑year recertification dates. If a business has fewer than 100 employees at recertification, it can send a written statement to claim an exemption.
