Fines and lawsuits to enforce ban

Starting January 1, 2032, a person who knowingly breaks the PFAS ban faces civil fines: up to $5,000 for a first violation and up to $10,000 for each later one. The Attorney General or the county State’s Attorney can sue in court to stop violations and get legal or equitable remedies. Fine money goes to the Environmental Protection Trust Fund. Manufacturers covered by Section 35 are not subject to these fines.

PFAS ban on personal and kids’ products

Beginning January 1, 2032, sellers in Illinois cannot sell cosmetics, dental floss, juvenile products, menstrual products, or intimate apparel with PFAS added on purpose. The rule covers makers, distributors, and retailers. It applies only when PFAS are deliberately added to do a job in the final product or a component.

What’s not covered by the PFAS ban

The ban starting January 1, 2032 does not cover used goods for resale, electronic or internal parts, or items where federal law preempts state rules. It also does not cover certain refrigerants, foams, and aerosol propellants that the U.S. EPA lists as acceptable for specific uses—except when used in personal care products. The law’s definition of “product” also leaves out medical devices, drugs, prosthetic or orthotic devices, their packaging, and products regulated under the federal pesticide law.
